Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of ClubHub (“ClubHub”, “we”, “us”), an online marketplace for buying and selling second-hand golf equipment in South Africa. By creating an account or using the platform you agree to these Terms. If you do not agree, please do not use ClubHub.

1. What ClubHub is (and is not)

ClubHub is a venue that connects private buyers and sellers of second-hand golf equipment. We are not a party to the sale agreement between buyer and seller, we do not own or inspect the items listed, and we do not act as a dealer. The contract of sale is concluded directly between the buyer and the seller.

Payments are processed and held in escrow by TradeSafe Escrow (Pty) Ltd, an independent, regulated escrow provider. ClubHub does not hold buyer funds at any point.

2. Eligibility and your account

  • You must be 18 years or older to use ClubHub.
  • You must provide accurate registration details and keep them up to date.
  • You are responsible for all activity on your account and for keeping your password secure.
  • Sellers must complete identity verification (KYC) and provide valid banking details with our escrow partner before they can receive payouts.

3. Listings

  • Listings are free. You may only list golf equipment that you own and are entitled to sell.
  • Listings must be accurate and complete, including genuine photographs of the actual item, its true condition, and full specifications. Stock photos or misleading descriptions are not permitted.
  • Counterfeit, stolen, or misrepresented equipment is strictly prohibited and will result in removal and account termination. We may report suspected stolen goods to the authorities.
  • We may remove any listing that breaches these Terms or that we reasonably consider harmful to the platform or its members.

4. How a transaction works

ClubHub transactions follow an escrow and meet-up model:

  • Payment into escrow. The buyer pays the purchase price plus applicable fees through TradeSafe. Funds are held in escrow — neither the seller nor ClubHub can access them.
  • Meet-up and inspection. Once funds are secured, a private chat opens for the buyer and seller to arrange a meet-up. The buyer inspects the item in person.
  • Release code. If the buyer is satisfied, they give the seller a release code. When the seller redeems the code, the escrowed funds are released to the seller. Redemption of the release code is final and constitutes the buyer’s acceptance of the item. No refund or remedy is available through ClubHub after the code has been redeemed.
  • 7-day cancellation window. If the release code has not been redeemed within 7 days of payment, the buyer may cancel the transaction and receive a refund of the amount held in escrow.

Only hand over the item against the release code, and only hand over the release code when you are satisfied with the item. Transactions concluded outside the platform are entirely at your own risk and are not protected.

5. Fees

  • Listing and selling on ClubHub are free.
  • Buyers pay a buyer-protection / service fee on each purchase, shown clearly at checkout before payment.
  • TradeSafe’s escrow processing fee is shared between buyer and seller and is also shown before payment.
  • Fees may change; changes apply only to future transactions.

6. Conduct

  • Questions about a listing happen publicly on the listing page. Do not attempt to solicit off-platform contact or payment, post spam, or harass other members.
  • Do not manipulate trust scores, reviews, or the Q&A system.
  • Meet-ups happen at your own discretion. We recommend meeting in safe, public places such as golf clubs or driving ranges during daylight hours.

7. Disputes

If something goes wrong before the release code is redeemed, you may raise a dispute on the order page. We will review the matter in good faith and may, where appropriate, instruct the escrow provider to refund or release funds. Our decision on platform disputes is made on the available evidence and is final to the extent permitted by law. Nothing in these Terms limits your statutory rights, including under the Consumer Protection Act 68 of 2008 where it applies.

8. Liability

Because ClubHub is a marketplace venue and not the seller, we do not warrant the quality, safety, authenticity or legality of listed items, nor the accuracy of listings or the ability of buyers and sellers to complete a transaction. To the maximum extent permitted by South African law, ClubHub’s total liability arising out of or in connection with the platform is limited to the service fees you paid to ClubHub in the 6 months before the claim arose. We are not liable for indirect or consequential loss.

Nothing in these Terms excludes liability that cannot be excluded under South African law.

9. Privacy

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

10. Suspension and termination

We may suspend or terminate your account if you breach these Terms, if required by law, or to protect other members. You may close your account at any time; obligations arising from transactions concluded before closure survive termination.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified on the platform or by email, and the “Last updated” date above will change. Continued use of ClubHub after changes take effect constitutes acceptance.

12. Governing law and contact

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
